Glenmark Pharmaceuticals' US subsidiary, Glenmark Pharmaceuticals Inc. USA, has agreed to settle multiple antitrust and consumer protection class-action lawsuits pending in the Eastern District of Pennsylvania for a total of $37.75 million. The lawsuits allege industry-wide price-fixing, market allocation, and anticompetitive conduct in the US generic drugs market, brought by putative classes of direct purchasers, end-payers, and indirect purchasers. The settlement is subject to court approval and will be paid in two tranches: $11.1 million after preliminary court approval and $26.65 million on or before April 1, 2026. Glenmark USA has denied all allegations and the settlement does not constitute an admission of liability or wrongdoing.
The $37.75 million settlement removes a key litigation overhang but represents a one-time cash outflow. While material, the amount is manageable and brings certainty by avoiding the cost and unpredictability of prolonged US litigation. Short-term sentiment may be mildly negative due to the payout, but the resolution of long-pending cases is broadly neutral to slightly positive over the longer term.
