In December 2023, the Office of Commissioner of Customs, Maharashtra imposed a Rs. 100 million penalty on Bayer CropScience for misclassification of exported goods under the Harmonized System rules. The company challenged the order before the Customs, Excise & Service Tax Appellate Tribunal (CESTAT). On January 20, 2026, the Tribunal set aside the entire impugned order in the company's favor. The demand for recovery of export incentives of about Rs. 13 million (with interest from FY 2016) and the Rs. 100 million penalty have both been quashed. The company confirmed no settlement amount or penalty has been paid, and there is no adverse impact on its financial position.
