BPCL has received an order dated February 21, 2026 from the Commissioner of Central Tax and Central Excise, Kochi, adjudicating 19 pending Show Cause Notices related to transaction value under Central Excise law for the period September 2004 to May 2010. The Adjudicating Authority confirmed an excise duty demand of Rs. 476.94 Crores, plus interest of approximately Rs. 1,339.70 Crores and a nominal penalty of Rs. 95 thousand, taking the total financial implication to Rs. 1,816.65 Crores. The ruling was based on the view that BPCL and its erstwhile subsidiary Kochi Refineries Limited (KRL) were related parties, and that the department's valuation method under Central Excise Valuation Rules, 2000 should apply instead of the Refinery Gate Price used by BPCL. The bulk of the demand pertains to the pre-merger period of KRL (September 2004 to August 2006). BPCL has stated it will analyse the order and file an appeal before the Customs, Excise and Service Tax Appellate Tribunal (CESTAT).
This is a negative development as a large excise demand (Rs. 1,816.65 Crores, mostly interest) has been confirmed by the Adjudicating Authority, though BPCL plans to appeal and the final outcome is yet to be determined.
