Honasa Consumer Limited (Mamaearth) has received a final arbitral award in its favour against RSMM General Trading LLC (RSM), its former authorised distributor based in Dubai. The arbitration, conducted in India under Justice (Retd.) Hrishikesh Roy, ruled that RSM breached the arbitration agreement by initiating proceedings in Dubai courts. The award declares Honasa's termination of the distribution agreement valid and injuncts RSM from further Dubai proceedings. RSM has been ordered to pay Honasa AED 7,254,340 (approximately INR 18.88 crore) towards costs and lost profits, plus INR 76.5 lakh towards arbitration costs. If unpaid after 30 days, post-award interest will apply. This award reverses the earlier Dubai court judgment that had initially ordered Honasa to pay approximately AED 25 million to RSM.
Positive development for Honasa — the favourable award significantly reduces the company's legal liability and validates its decision to terminate the distributor agreement. The company is now entitled to recover costs and damages from RSM.
