NCLT Ahmedabad rejected the Section 9 IBC insolvency petition filed by Rosefinch Healthcare Hongkong against Sikko Industries. The petition sought to initiate insolvency over an alleged default of USD 765,000 (about Rs 6.56 crore) from sale of insecticides. The tribunal found a pre-existing dispute regarding the alleged sale contracts and unauthorized third-party transactions by Barna International, and rejected the application as not maintainable.
Positive for shareholders: company avoids insolvency proceedings and CIRP initiation; no disruption to operations from this petition.
